UAE) and are inclusive of applicable VAT in the UAE, unless stated otherwise.
• Prices DO NOT include shipping charges, customs duties or import taxes for
international orders; these will be shown or indicated at checkout where possible.
• All prices, product descriptions and availability information are subject to change at
any time without notice.
We make reasonable efforts to ensure product information is accurate; however, we do
not warrant that descriptions, pricing or other content is error-free. If we discover an error
affecting your order, we may contact you with options or cancel the order and issue a
refund.

Gift vouchers / credit notes (if issued):

11. Orders & Contract
When you place an order on the Website:
1. You are making an offer to purchase the selected products in accordance with

2. We may accept or decline your order at our discretion.
3. A binding contract between you and Studio Earth is formed only when we send you
an order confirmation email and charge your chosen payment method.
We may refuse or cancel an order (with a refund where applicable), for example if:
• The product is out of stock.
• There are pricing or description errors.
• Your payment is not authorised.
• We suspect fraudulent or unauthorised activity.
12. Payments
We use third-party payment processors to handle online payments securely. By providing

Studio Earth is not responsible for:
• Any error, delay or failure caused by your bank, card issuer or payment provider.

13. Shipping, Delivery & Risk of Loss
Shipping and delivery are governed by our Shipping & Delivery policy (which forms part of
these Terms). Key points:
• Risk of loss and title for products pass to you upon delivery to the address you
provide, or upon collection from our delivery partner where applicable.
• We will make reasonable efforts to deliver within the estimated timelines; however,
delays can occur due to courier issues, customs or events beyond our control.
Failure to accept delivery or provide accurate address details may result in additional
charges and/or cancellation of the order without refund, as described in our Shipping &
Delivery policy.
14. Returns, Exchanges & Refunds
Our Returns & Exchanges policy (which forms part of these Terms) explains when
exchanges or credit notes may be issued.
In summary:
• We DO NOT accept returns or exchanges for change of mind.
• Exchanges are only considered in the rare case of damage in transit or a
clear manufacturing defect, and only if reported within the stated timeframe with
supporting photographs.
• Any decision regarding exchanges, credit notes or replacement items is at the sole
discretion of Studio Earth, in accordance with our published policies.
15. Product Descriptions & Colours
We try to display product colours and details as accurately as possible. However:
• The colours you see will depend on your device and screen settings.
• As many of our pieces are individually finished, minor variations in colour, glaze or
pattern are natural and part of the character of the product, not defects.
If you believe a product is materially different from its description, please contact us
promptly so we can review.
16. Warranties & Disclaimer
Except as expressly provided in writing:
• The Website and all content, products and services made available through it are
provided on an “as is” and “as available” basis.
• Studio Earth makes no representations or warranties of any kind, express or
implied, including but not limited to warranties of merchantability, fitness for a

viruses or other harmful components.
To the fullest extent permitted by applicable law, you use the Website at your own risk.
17. Limitation of Liability
To the fullest extent permitted by applicable law:
• Studio Earth, its owners, directors, employees, agents and affiliates shall not be
liable for any indirect, incidental, special, consequential or punitive damages, or
any loss of profits, revenue, data or goodwill arising out of or in connection with your
use of (or inability to use) the Website, any products purchased, or these Terms.
• Our total aggregate liability to you for any claim arising out of or relating to the
Website, products or these Terms shall not exceed the total amount paid by you for
the specific order giving rise to the claim.

gross negligence, fraud, or any other liability that cannot be excluded under applicable

Studio Earth shall not be liable for any delay or failure to perform any obligation under
these Terms if such delay or failure results from events beyond our reasonable control,
including but not limited to acts of God, war, terrorism, riots, government actions, strikes,
lockouts, natural disasters, epidemics, disruptions in transportation or communications,
or failures of third-party service providers.
21. Severability
If any provision of these Terms is found to be invalid, illegal or unenforceable by a court of
competent jurisdiction, that provision shall be deemed severed and the remaining
provisions shall continue in full force and effect.
22. No Waiver
Any failure by Studio Earth to enforce any right or provision of these Terms shall not
constitute a waiver of that right or provision, nor of any other rights or provisions.
23. Governing Law & Dispute Resolution
These Terms and your use of the Website are governed by and construed in accordance
with the laws of the United Arab Emirates.
Any dispute arising out of or in connection with these Terms, the Website or any products
purchased shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE,
without regard to conflict of law principles.
